US Judge Orders Release of Abrego Garcia from ICE Custody

A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without legal authority.

"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.

The situation originates in a erroneous deportation to El Salvador in March, which the government later acknowledged was an error. Following his repatriation to the United States to face human smuggling charges, he was detained in immigration detention.

In her order, the court pointed out that the government does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

Context of the Case

The court challenge center on disputed claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.

He has also entered a not guilty plea to the smuggling charges, which are part of a separate criminal case in the state of Tennessee.

Conditions of Release

The court, who was hearing his petition to removal in a Maryland district court, determined that he must now adhere to the terms of his bond from jail in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.
